How To View Utah County Arrest Records for Free

Records for persons that are arrested and result in a record being created in Utah County bookings are all free and publicly accessible. The Utah County Sheriff’s Office is the best place to start. The local police departments where the arrest took place are also a good source for finding arrest records.

However, it’s not possible to find someone’s mugshot due to Utah state law H.B. 228 Jail Photo Distribution Prohibition, which prohibits police departments from releasing mugshots to the public until such time that the arrestee has been convicted.1

The intent of this law is to protect those arrestees who are ultimately not convicted of the crime for which they were arrested from the long term adverse consequences of having a mugshot released to the public even though a conviction never takes place.

Find Utah County Arrest Logs Through the Sheriff’s Office

At the county level, an arrest record may be searched via the Utah County inmate lookup tool. An arrestee’s full or partial name and the arrest date can be used as search parameters.

The search returns a list that shows the full name, year of birth, booking date, Identification number, and a status code.

If the inmate search doesn’t return the arrest record that is sought using the database search tool, Utah County provides a web portal on which an open public records request can be made. On the web portal, a request form is completed to include a detailed description of the arrest record. As much of the following data as possible should be included in the request:

  • Subject
  • Dates
  • Names (All known persons involved in the subject matter)
  • Addresses
  • Type(s) of Records
  • Case Number

Requesters will be provided with a response within 10 days.

When a fee is charged, if the research and response by the sheriff’s office is completed within 15 minutes, the record is provided to the requestor without charge. Thereafter, a charge $25.00 per hour is imposed to cover the actual cost of retrieving and delivering the record. Charges for media materials, for example thumb drives, may be included when applicable.

A fee waiver may be requested and is at the discretion of the Utah County Sheriff’s Department.

Police reporting procedures may vary among the various police departments within Utah County. This may result in the arrest records that originate at the local police departments containing information that is not found in the arrest records at the county level.

How To Obtain Utah County Criminal History Information

The public can access most Utah County public records through county and state agencies.

Between these two levels of government and the courts and law enforcement agencies underneath them, records about criminal offenses, probation and parole, warrants, prisoner information, sex offender registries and background check reports can be found for free in most cases.

However, juvenile records aren’t available to the public, and only the minor’s parents and their authorized legal representative may receive the minor’s incident and criminal records with appropriate redactions.

Through the resources and information below, anyone can look up someone’s criminal record to access an abundance of information on them.

Search Utah County Criminal Records Through the District Courts, Xchange & MyCase

Criminal records handled by the Utah County District Courts include domestic, probate, civil, and criminal cases that are felonies or class A misdemeanors and above.

Utah County criminal records for infractions, traffic cases, class B and C misdemeanors, and all small claims cases can be obtained through the Justice courts by means of a Government Records Access and Management Act (GRAMA) records request.

The request must be made in writing either by an online GRAMA request form, or by downloading a GRAMA written request form via the like provided and sending it in by mail, Email, or in person via the following contact information:

The GRAMA, Utah Code § 63-2-203 authorizes the Utah County Attorney’s Office to charge reasonable fees for GRAMA requests that cover the actual costs for staff time, copies, mailing/shipping, certifying a document, and any other services associated with the processing and delivering of the requested record. The fees will vary depending on the size and type of record.

On the state level, the Utah State Courts provide a separate search tool referred to as MyCase on which persons can view their own court records for free.6 The MyCase service also requires that an account be set up to use the search tool. To set up an account, users will need an email address, a case number, and a government-issued identification.

Furthermore, Utah County Courts also has an online records database, referred to as Xchange where citizens can look up anyone for a nominal fee.7

Included in the repository is a criminal records database for district court and justice courts. District courts handle domestic, probate, civil, and criminal cases including felony and class A misdemeanor cases.

Justice courts are limited jurisdiction courts and deal with infractions, traffic cases, class B and C misdemeanors, and all small claims cases.

A search of the Xchange database will return summary information about criminal cases including:

  • Names of case parties
  • Addresses case parties (if available)
  • Assigned judges
  • Attorneys of record
  • All documents filed
  • All hearings held and court date
  • Judgments
  • Outcome of completed case

Records that are not displayed for public inspection on the Xchange database include sealed cases, such as civil commitments or adoptions. Cases that are expunged aren’t displayed on Xchange. Cases that are under the jurisdiction of juvenile courts such as child welfare, juvenile delinquency, and termination of parental rights are not available on the Xchange database.

There is a charge to search and download records on the Xchange database. Users are required to subscribe and set up an account to use the Xchange service.

There are three options to choose from to use the service:

One-Time Use account – An initial fee of $5.00 is charged. Searches are charged $0.20 each and documents are charged $0.50 each. The charges are deducted from the initial fee. Remaining credit balance can be used at a later time.

Guest account – Same as the One-Time Use account with the exception that any remaining credit balance will be forfeited.

Monthly Subscription – Requires a subscription to the service. The initial set is $25.00, thereafter a charge of $40.00 per month until the subscription is canceled. This fee covers 500 searches.

Documents remain at $0.50 each. After 500 searches are exceeded, cost per search is $0.15 each until the end of the billing cycle.

How To Perform a Warrant Search in Utah County Utah

The Utah County Sheriff’s Office Fugitive Investigations/Extraditions Team webpage provides a link at the bottom of the page that leads to the States of Utah website; here, a statewide warrants search tool on which Utah County warrants that have been reported to the state can be searched.

Warrants can be searched using first and last names as the search parameters. The search will return a list of outstanding warrants that match the search parameters. Selecting a name from the list brings up the details of the warrant including full name, age, case number, court name, and charges.

How To Determine if a Utah County Resident Is on Probation

The Utah County website provides a Utah County Probation Team (UCP) web page which lists information on the Utah County Probation Program and contact information to make in-person, email, mail, or phone inquiries:9

The Utah County website search tool that is used for searching arrest records does not provide searches for a person’s probation status. The State of Utah inmate search tool provides the public with information on the probation status of inmates. Inmates who committed crimes in Utah County and where or are incarcerated by the State of Utah Department of Corrections are listed in this database.

A search of the database returns a probation status as part of the record for offenders that are on probation throughout the State of Utah to include offenders in Utah County.

How To Acquire a Background Check Report in Utah County Utah

Background checks are often a standard part of a hiring procedure that is very often a state or federal law requirement for many agencies, including law enforcement and the military.

Other processes such as applying for housing or a firearms license or when applying to work with children or the elderly, which are protected groups of people, are also examples of a need for a professional background check.

There are also occasions for personal background checks. A need may arise to learn more about a family member, colleague, neighbor or potential spouse. So long as the motive to do a personal background check is not nefarious in nature such as intimidation, stalking, or harassment, anyone can run a check on public records without consent.

Personal background checks can also be done through third-party ‘people finder’ websites.

As per the Fair Credit Reporting Act, the person for whom a professional background check is for must provide explicit written consent. If a background check is obtained without consent, a fraud charge may be filed with the Federal Trade Commission (FTC). Also, all parties are restricted from using information obtained from a background check in such a way that is malicious or discriminatory, as prescribed in the Fair Credit Reporting Act.

If a person has become a victim of employment discriminatory practices, the means for which to file an employment discrimination charge is provided by the Equal Employment Opportunity Commission.

The Utah County Sheriff’s Office does perform comprehensive background checks for its own sworn and non-sworn applicants, but not for private individuals for their request. For this, a GRAMA records request from the Utah County Sheriff’s public records Administrative Division is necessary.11 This background check is limited to Utah County records only.

When the Utah County public records repository is used for background checks, only name criteria is used for the search. These background checks performed at the county level are referred to as Level 1. The purposes that they can be used for are limited due to the lack of depth with respect to the public index and records that are searched.

The State of Utah provides background checks via the Utah Department of Public Safety Utah Bureau of Criminal Identification (BCI).12

These checks are considered level 2 background checks and are used for purposes that involve positions of responsibility and trust with higher sensitivity. Three options are available to suit the different needs for background checks.

  • Personal Records Check – Performed via Utah BCI and the FBI. These checks are requested and received by the person being checked.
  • Name and DOB Check – Conducted via Utah BCI. Used for employment consideration purposes.
  • Fingerprint-based Record Check – Completed via Western Identification Network(WIN) and the FBI. These are level 2 fingerprinting background checks. These checks are much more expansive and include national criminal databases. Level 2 background check searches include:
    • Nationwide criminal information (i.e., arrests and any pending cases)
    • Prison and jail records
    • All previous addresses
    • Civil judgments
    • Marital status

A Level 2 fingerprinting background check will require an in-person appointment with the Utah Department of Public Safety (BCI) Fingerprinting Services.13 An appointment can be made online at the fingerprinting services appointment portal. A government-issued identification (i.e. driver’s license, state Identification card, passport, etc.) will be required for the service to be performed.

A $15 fee is charged for the fingerprinting service done by BCI. A second option is to use fingerprinting vendors approved by the State of Utah. A link to a list of vendors is provided on the fingerprinting services appointment portal.

Fees by vendors may vary for each vendor.

Additionally, the fee charged by BCI to conduct the background check is $15.

How To Review All Criminal Records in Utah via State & Federal Agencies

The State of Utah Department of Corrections inmate search tool provides the public with a free limited criminal record that pertains to the information on an inmate who is currently incarcerated in state and county correctional facilities.

The State of Utah Department of Corrections provides a sex offender registry search tool on which a free criminal record check for sex offenders can be performed. A search can be done by name, geographical location, city, and non-compliant offenders.

The search returns a detailed description of the offender along with a known address, offenses, and a mug shot.

Also available to the public is the United States Department of Justice nationwide sex offender registry search tool. The records derived from searching sex offender registries only return information pertaining to the sex offense.

Another source for searching criminal records at the federal level is the United States Federal Bureau of Prisons. It provides a federal inmate locator tool for inmates incarcerated at a federal facility. The criminal record provided by this search tool is very limited.

For more detailed records, the U.S. District Court for the District of Utah maintains federal court records that can be searched using the Public Access to to Court Electronic Records (PACER) system.16 The PACER system requires that an account be set up by the user.

How To Look Up Utah County Court Records & Cases

There are online methods to obtain court records and they’re detailed right below this. On the county level, though, requests for Utah County court records must be done in person at one of the public access terminals within the Utah County District Court:

Included in the request should be the information needed to obtain the specific record including name, date of birth, and case number if available, and a list of what documents are requested. For records to be mailed, a delivery address will be necessary.

For online requests, all of the county district and justice courts in the State of Utah enter court records into the Courts Information System (CORIS). Utah County judicial records can then be found via a Utah County case search through either the Xchange or MyCase search tools provided by the State of Utah (as described in the prior section of this article).

How To View & Obtain Utah County Utah Vital Records (Marriage, Divorce, Birth & Death Information)

Most people pay no mind to vital records until a situation arises when vital records such as certificates of death, certificates of birth, marriage records, and divorce decrees, become a necessity. Situations with seldom occurrence such as applying for military service or any other job that requires a background check, or obtaining a passport.

Applying for acceptance to a university or student financial aid is another example. An inheritance claim. Researching paternity, genealogy, or simply performing due diligence on a potential spouse may also spur a need for vital records.

As a public service, most counties and states in the U.S. serve as custodians of vital records.

Some vital records are not available to the public until a given amount of time has passed since the date of origin or specific criteria is met. For the most part, if the vital record is historical in nature and pertains to a person who died long ago, then the vital record is usually public, and anyone can access it.

If the record is for a living person, then in order to protect the privacy of the person, the vital record is usually not public. For Utah County, birth certificate records are closed for 100 years from the birth date, and death certificate records are closed for 50 years after the date of death.

For vital records that are not yet public information, they can be accessed exclusively by an adult who is one of the following parties:

  • Parents
  • Self
  • Spouse
  • Siblings
  • Child
  • Grandparents
  • Grandchild
  • Designated legal representative

Requesting vital records requires that an acceptable identification be provided. A link to a list of acceptable forms of identification can be found on the birth and death certificate information webpage.

Retrieve Divorce & Marriage Records Through the Utah County Clerk’s Office or Online State-Run Databases

Requests for vital records from Utah County may be made online through the Utah County Health Department vital records.18 Utah County public records are available for anyone to search and check if someone is married.

The Utah County Clerk’s Office provides a Utah County marriage records search tool on which a marriage record can be searched by name.

The search returns a list of married couples with a date of ceremony. Selecting a record on the list returns a marriage record with a marriage license number. On this webpage, a user can find out if someone is married.

Also, from this page, a certified marriage certificate can be ordered for $10 plus shipping costs.

Historical Utah County marriage records from 1887 to current can be accessed online via the State of Utah Division of Archives and Records.

Finding Utah County divorce records is a different procedure. A divorce results in a civil court action which generates a civil court case record. Divorce records can be searched on the Utah State Courts Xchange public records of or MyCase database.

Request Birth & Death Certificates via the Utah County Health Department

Certificates of death and certificates of birth are accessible through the Utah County Health Department. To search and order birth or death certificates online, the Utah County website directs users to the State of Utah Office of Vital Records. This website requires that an account with a username and password be created.

An email address, first and last name, and phone number are needed to create an account. Once logged in, the certificates can be searched and ordered.

Requests for vital records in Utah County can be made in person or via telephone. Fees charge for a certificate of birth is $27, and for a certified certificate of death is $30. Additional charges may apply for mailing costs.

Mail-in orders require that a birth certificate request form, or a death certificate request form be downloaded, printed, and mailed to the following address along with the appropriate fee can be mailed.

Understanding Your Rights & Using Utah County Public Records Responsibly

Any citizens and public officials who utilize online directory search tools to check public records should do so responsibly and avoid any malice to fellow citizens.

The situations that prompt someone to conduct a search of public records in Utah County are first for personal use. These searches are available to anyone for any reason, so long as the information is not used for criminal intent. Examples may include evaluating creditworthiness, employment considerations, tenant or rental screenings, or business-related activities.

The second relates to professional uses.
